Availability, information requests and managed contracting.

Information and request model

The information published on this website describes areas of work, products, services, licences, terms and indicative prices. However, the website does not operate as an automatic immediate-contracting store or mass-download system.

Each request may require technical review, availability confirmation, authorised environment review, express acceptance of terms and, where applicable, a quotation or contracting document.

Non-binding requests

Submitting a form, query, message, information request or licence interest does not constitute effective contracting and does not oblige Actual Trading to accept, install, activate, renew or supply any product or service.

Indicative prices and confirmed quotation

Published prices, plans or modalities, where available, are informative and indicative. The applicable price will be the one confirmed in a quotation, proposal, proforma invoice, acceptance document or express communication, considering product, duration, installation, support, authorised environment and any additional services required.

Licences subject to availability

Actual Trading software licences are supplied subject to availability, technical validation and prior confirmation. A request is not accepted automatically by submitting a form or enquiry.

Actual Trading may assess each case before accepting a contract, especially where the product requires controlled installation, technical activation, support, adaptation to the client environment or specific software protection.

Prior technical review

Where necessary, Actual Trading may review the client’s technical environment, NinjaTrader® version, permissions, operating system, market data, hardware, configuration or any other reasonable requirement before confirming a licence, service or installation.

Managed installation and activation

Actual Trading prioritises controlled installation, authorised environments and software protection. Unless expressly authorised, no source code, standalone installer or components enabling unauthorised copying, modification, redistribution or reinstallation are delivered.

Demos and evaluation licences

Where authorised by Actual Trading, technical demos or controlled evaluation licences may be provided. These modalities do not create any acquired right to renewal, continuity, future availability, delivery of a standalone installer or definitive commercial provision.

Effective contracting

Effective contracting will only be deemed formalised when there is express confirmation from the holder of Actual Trading, acceptance of the applicable terms and, where applicable, a quotation, contracting document, confirmed payment, agreed activation or expressly accepted start of provision.

Relationship with legal terms

This model is complemented by the general contracting terms, software-specific terms and service terms. In case of doubt, interpretation will favour the protection of intellectual property, technical security, service quality and any mandatory rights applicable to the client under applicable law.
