Specific terms for services, training, support and development.

Terms applicable to training, technical support, consulting, custom development, automation, NinjaTrader configuration, hardware and related services.

1. Scope

These terms apply to training, technical support, consulting, platform review, custom development, automation, NinjaTrader configuration, indicator review, educational-technical analysis, installation, remote assistance, hardware, equipment and any other service provided by Actual Trading.

2. Defined scope

The scope of each service will be the one described on the relevant page, quote, proposal, confirmation email or specific terms. Any service not expressly described is excluded and may be quoted separately.

3. Custom development

Custom developments will be performed according to agreed specifications. Scope changes, new features, unplanned changes, third-party integration, additional testing, extended documentation or repeated revision rounds may require a new quote.

Unless expressly agreed in writing, developments do not include source-code delivery, transfer of intellectual property, exclusivity, indefinite maintenance or unlimited support.

4. Training and content

Training is educational and technical. It does not constitute personalised financial advice, investment recommendation or guarantee of results.

Sessions, materials, recordings, documents or resources supplied may not be recorded, copied, redistributed, published, resold or shared with third parties without express authorisation.

5. Technical support

Support is provided within the contracted scope and subject to availability. Actual Trading may request technical information, screenshots, logs, remote access or reasonable checks to diagnose incidents.

If an incident derives from third parties, operating system, hardware, broker, data provider, antivirus, external configuration, client actions or incompatible environment, the intervention may be treated as an additional service.

6. Hardware and equipment

For services related to computers, screens, peripherals, configuration or equipment, Actual Trading may advise, configure, review or install according to the agreed scope. Where Actual Trading is not the direct seller, legal or commercial warranty for physical products corresponds to the manufacturer, seller or relevant supplier.

Third-party availability, prices, compatibility and specifications may vary.

7. Client cooperation

The client must provide access, information, availability, permissions, connection, licences, passwords, devices and reasonable cooperation. Delays, errors, blocks or impossibility caused by lack of cooperation may affect deadlines, costs and scope.

8. Cancellations, absence and delays

If the client does not attend a session, cancels without sufficient notice, lacks the required environment or prevents the intervention, Actual Trading may treat the service as fully or partially consumed where resources have been reserved or costs incurred.

9. Deliverables

Deliverables are those defined in each proposal or service. In the absence of express agreement, source files, internal documentation, private procedures, editable templates, reusable configurations, third-party licences or undescribed materials are not included.

10. Technical limitation

Actual Trading does not guarantee that a service will solve incidents caused by third parties, external platforms, NinjaTrader restrictions, version changes, broker errors, data-provider issues, operating-system limitations, insufficient hardware or circumstances outside Actual Trading's control.
